Bali Best Law Office Successfully Mediates 1.1 Hectare Land Dispute in Canggu

BALI — A leasehold dispute involving approximately 1.1 hectares of land in Canggu, Bali, which had previously attracted public attention and eventually reached the courts, has now been resolved amicably.

The case involved two foreign nationals, identified by the initials J.P. and P.C.M., in connection with a leasehold transfer transaction of significant value.

The transaction initially proceeded under an agreement executed before a notary. However, disagreements later arose regarding the performance of obligations between the two parties.

The dispute became increasingly serious. Communication between the parties reached an impasse, and the matter was eventually brought before the Denpasar District Court.

During the court proceedings, the final payment under the transaction was also placed with the court through a consignment mechanism.

Given the size of the land, its location in one of Bali’s most rapidly developing areas, and the fact that the dispute had already entered court proceedings, the case also drew public attention.

From the Courtroom Back to the Negotiating Table

Although the legal process was already underway, the possibility of an amicable settlement remained open.

Bali Best Law Office, together with its legal team, assisted J.P. throughout the dispute resolution process. While the court proceedings continued, communication with P.C.M. was reopened in an effort to explore a settlement outside the courtroom.

The process was not straightforward. At one stage, the parties were far apart in their respective positions and each had interests they were determined to protect.

However, after a series of meetings and negotiations, common ground gradually began to emerge.

J.P. and P.C.M. ultimately agreed to settle the dispute amicably. The settlement was then documented in writing and formalized before a notary.

Following the settlement, the remaining processes before the Denpasar District Court were also completed. This included the release of funds previously placed with the court through the consignment mechanism, which have now been returned to J.P.

With that, the long running dispute between the two parties came to a complete end.

Winning Does Not Always Mean Fighting Until the End

Managing Partner of Bali Best Law Office, Rio Handa Aji, said that in a dispute, the most important question is not how long the parties are willing to fight, but what can ultimately be achieved for the client.

“Once a case reaches court, each side usually becomes more determined to maintain its position. But for us, the most important thing is the final result. If there is a way to give the client certainty without continuing the fight unnecessarily, that door should remain open,” Rio said, Friday, 14/8.

According to Rio Handa Aji, litigation and negotiation do not always have to work against each other.

“The court process continued, but we never closed the door to communication. Eventually, we reached a point where both sides were able to sit down and find a way forward,” he said.

He added that a successful resolution should not be measured only by whether a settlement agreement has been signed.

“A settlement on paper is important, but what matters more is making sure everything is actually completed. In this case, the agreement was reached, all remaining court processes were completed, and the consignment funds were returned to the client. There is nothing left to dispute,” Rio said.

The matter, which began as a high value transaction and later developed into a court dispute, has now been resolved amicably, bringing the entire process before the Denpasar District Court to a close.
